Public notice: Land Use Recovery Plan amendments

Amendments following the review of the Land Use Recovery Plan.

In April 2016, the Minister for Canterbury Earthquake Recovery (now the Minister supporting Greater Christchurch Recovery), Hon Gerry Brownlee, under section 22 of the Canterbury Earthquake Recovery Act 2011 has given approval for several minor amendments to be made arising from Environment Canterbury’s review of the Land Use Recovery Plan (the Recovery Plan). These amendments will clarify the interpretation and assist with the application of the Recovery Plan:

  • making Figure 4 of the Land Use Recovery Plan ‘indicative only’
  • removing Appendix 1 of Volume Two
  • updating the status of the 50 actions.

Approval was also made under section 27 of the Canterbury Earthquake Recovery Act 2011 to amend the following Resource Management Act documents to change the location of the Avon River mouth and the Coastal Marine Area Boundary to respond to the change in estuary dynamics as a result of land subsidence following the Canterbury earthquake sequence:

The Canterbury Regional Policy Statement

The Christchurch District Plan

The Waimakariri District Plan to clarify that the Land Use Recovery Plan provisions apply only in the area described in the whole of greater Christchurch of Map A in the Canterbury Regional Policy Statement.

The amendments to the Land Use Recovery Plan were gazetted on 14 April 2016, and all amendments were publically notified in The Press on 16 April 2016 and apply immediately.

The Land Use Recovery Plan

The Recovery Plan took effect on 6 December 2013 and provides direction for residents, businesses and councils of greater Christchurch about where development should occur and what form it should take to support recovery.

Amendments following the review of the Land Use Recovery Plan

Pursuant to section 22 of the Canterbury Earthquake Recovery Act 2011, the Minister supporting Greater Christchurch Regeneration gives the following notice:

The Land Use Recovery Plan is amended with effect from 14 April 2016 by:

  • Making Figure 4 of the Land Use Recovery Plan “indicative only”
  • Removing Appendix 1 of Volume Two
  • Updating the status of the 50 actions.

Pursuant to section 27 of the Canterbury Earthquake Recovery Act 2011, the Minister supporting Greater Christchurch Regeneration gives the following notice:

The Regional Coastal Environment Plan for the Canterbury Region is amended from the publication of this notice on 16 April 2016 by:

  • Amending Volume 3 - Coastal Hazard Zones: Map 4 Coastal Hazard Zones Map: Christchurch 4
  • Amending Volume 2 - Coastal Water Quality Maps: Map 1.4 Water Quality Areas - Estuary of the Heathcote and Avon Rivers/Ihutai, Heathcote and Avon River Mouths
  • Amending Volume 2 - Areas of Significant Natural Value: Map 7.14 Areas of Significant Natural Value S5.5.15 - Estuary of the Heathcote and Avon Rivers/Ihutai
  • Amending Volume 2 - Prohibited Areas for Vehicles and Prohibited Area for Vessels and Vehicles: Map 4.4 Prohibited Area for Vehicles: Brighton Beach to Spencer Park, Estuary.

The Canterbury Regional Policy Statement is amended from the publication of this notice on 16 April 2016 by:

  • Amending Appendix 5: Coastal Hazard Zones Map 4 Christchurch Map Series.

The Christchurch District Plan is amended from the publication of this notice on 16 April 2016 by:

  • Amending Maps 34 and 41 - Operative Christchurch City Plan
  • Amending Maps 33 and 34 - Proposed Christchurch Replacement District Plan
  • Amending Maps 33 and 34 - Operative Christchurch District Plan.

These amendments apply to the location of the Avon River mouth and the Coastal Marine Area Boundary to respond to the change in estuary dynamics as a result of land subsidence following the Canterbury earthquake sequence.

The amended maps can be viewed on the Christchurch City Council’s website www.proposeddistrictplan.ccc.govt.nz

The Waimakariri District Plan is amended from the publication of this notice on 16 April 2016 by:

  • Deleting Policy 14.5.1.1 and replacing it with a new Policy 14.5.1.1.

This amendment clarifies that the Land Use Recovery Plan provisions apply only in the area described in the whole of greater Christchurch of Map A in the Canterbury Regional Policy Statement.
